In recent weeks, we informed you about the progress of work on the draft act amending the Act on the National Labour Inspectorate and certain other acts (legislative work list no. UD283). Despite the adoption of the draft by the Standing Committee of the Council of Ministers on December 4, 2025, an unexpected political reversal has occurred, which in practice entails the suspension of the reform’s key assumptions.
During a press conference on January 6, 2026, Prime Minister Donald Tusk announced the decision to discontinue proceeding with the amendment in the form that would grant labour inspectors the power to reclassify civil law contracts (including B2B contracts) into employment contracts by virtue of an administrative decision.
Justifying his position, the Prime Minister pointed to the excessive risk associated with granting officials such far-reaching competencies, which would interfere with the freedom of contract. In the Prime Minister’s assessment, the “extreme version” of the project, assuming changes without the consent of the parties to the legal relationship, could have destructive effects on the labour market and a significant group of entrepreneurs. The Prime Minister declared the matter of reform in this scope closed.
Our Recommendations
Although draft UD283 in its radical form has been politically blocked for the time being, this does not exempt entrepreneurs from the obligation to ensure the legal compliance of their cooperation models. It should be remembered that the PIP still retains inspection powers and may file a claim with the labour court on behalf of employees. Furthermore, the issue of new PIP powers constitutes one of the “milestones” of the National Recovery and Resilience Plan (A71G KPO), which is required to be implemented by Poland no later than August 31, 2026.
Therefore, despite the “political thaw,” we maintain our recommendation to verify the B2B and civil law contracts applied in your organization.
